1. Agreement
By creating an account, accessing, or using Miss Blue, you agree to these Terms of Service and our Privacy Policy. If you use Miss Blue for an organization, you represent that you have authority to bind it to these terms.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract. Provide accurate account information, keep credentials confidential, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account and for the people you authorize to use it.
3. The service
Miss Blue provides messaging numbers, a shared conversation inbox, APIs, integrations, and related tools. Features, limits, and availability may differ by plan, region, number, integration, or preview status.
Numbers are licensed for use with the service and are not sold to you. Number selection, activation, portability, continued availability, and delivery are not guaranteed.
4. Messaging rules and consent
You may message only people you are legally permitted to contact. You are responsible for obtaining and documenting any consent required by law, clearly identifying the sender when required, providing compliant opt-out instructions, promptly honoring opt-outs, and following applicable marketing, privacy, telecommunications, and consumer-protection laws.
Do not use purchased, scraped, or unlawfully obtained contact lists. Do not obscure who is sending a message or use Miss Blue to evade carrier, platform, or recipient protections.
5. Acceptable use
You may not use Miss Blue for unlawful, deceptive, fraudulent, harassing, threatening, hateful, exploitative, or abusive activity; spam or unsolicited bulk messaging; phishing or impersonation; malware distribution; infringement of another person’s rights; interference with the service; unauthorized security testing; or attempts to bypass access, rate, or safety controls.
You may not resell account access, share secret API credentials outside your organization, reverse engineer the service except where law expressly permits it, or use automated traffic that creates unreasonable load.
6. Customer content
You retain ownership of content you submit. You grant Miss Blue a limited, worldwide license to host, transmit, reproduce, and otherwise process that content only as needed to provide, secure, support, and improve the service or comply with law. You represent that you have the rights necessary to submit the content and authorize this processing.
7. Fees and taxes
Paid features, usage charges, billing intervals, and limits will be described at purchase or in an order form. Unless stated otherwise, fees are non-refundable and exclude applicable taxes. We may change pricing prospectively after providing notice required by law or your agreement.
8. Service changes and third parties
We may add, change, suspend, or discontinue features. Preview and beta features may be incomplete and may change without notice. The service depends on third-party platforms, networks, and providers that Miss Blue does not control.
Miss Blue is an independent service and is not sponsored by, endorsed by, or affiliated with Apple Inc. iMessage and Apple are trademarks of Apple Inc.
9. Suspension and termination
You may stop using Miss Blue at any time. We may limit, suspend, or terminate access if we reasonably believe there is a violation of these terms, a security or legal risk, harmful messaging activity, nonpayment, or a need to protect recipients, customers, third parties, or the service. Where practical, we will provide notice and an opportunity to resolve the issue.
10. Disclaimers
To the maximum extent permitted by law, Miss Blue is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not guarantee uninterrupted service, message delivery, recipient engagement, response rates, or business results.
11. Limitation of liability
To the maximum extent permitted by law, Miss Blue and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity. Aggregate liability arising from the service will not exceed the amount you paid to Miss Blue for the service during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Indemnification
To the extent permitted by law, you will defend and indemnify Miss Blue against third-party claims arising from your content, your messaging recipients or campaigns, your violation of law, or your material breach of these terms.
13. Governing terms
The governing law, venue, and any dispute-resolution process must be completed with Miss Blue’s operating-entity details before these terms are published. An order form or separately signed agreement controls if it expressly conflicts with these online terms.
14. Changes and contact
We may update these terms. We will post the revised version here and update the effective date. Continued use after the new terms take effect means you accept them, to the extent permitted by law.
